These Terms of Service (“Terms”) govern your use of berserkertreeandlandscaping.com and the tree service and landscaping work performed by Berserker Tree and Landscaping (“Berserker,” “we,” “us,” or “our”). By requesting a quote, hiring us, or using this site, you agree to these Terms.
Scope Of Services
Berserker provides tree removal, tree trimming and pruning, stump grinding, storm and emergency response, lot clearing, and related tree and landscape services in Richland, Kennewick, Pasco, West Richland, Benton City, Prosser, and the surrounding Tri-Cities, Washington area. The specific work to be performed for any customer is described in the written estimate or work order for that job.
Estimates And Quotes
Estimates are free and non-binding until accepted. Quotes are based on the conditions observed at the time of the estimate and the information you provide. If site conditions change materially (additional trees, hidden hazards, access limitations, unexpected utilities, etc.), we may adjust the price after discussing the change with you. Written quotes are valid for 30 days unless stated otherwise.
Scheduling And Cancellations
We schedule work in the order jobs are booked and adjusted for weather, safety, and emergency response. If you need to reschedule or cancel, please give us at least 48 hours’ notice. Cancellations made less than 24 hours before a scheduled crew arrival, or no-shows, may be subject to a trip charge to cover crew and equipment time. Emergency and storm response work is prioritized based on safety and property risk.
Payment Terms
Payment is due upon completion of the work unless another schedule is agreed to in writing. We accept common payment methods offered at the time of service. Deposits may be required for large jobs, crane work, or specialty scheduling. Past-due balances may accrue reasonable interest and collection costs as permitted by Washington law.
Property Access And Site Conditions
You represent that you own the property or have permission from the owner to authorize the work. You are responsible for identifying the location of private irrigation lines, invisible pet fences, septic systems, low-voltage wiring, and other underground utilities that are not marked by public locates. Please move vehicles, patio furniture, and valuables from the work zone before we arrive. Some minor lawn impressions from equipment are normal in tree work, and we take reasonable care to minimize them.
Limitation Of Liability
Berserker is licensed, bonded, and insured in the State of Washington and performs work using industry-standard practices and safety procedures. To the fullest extent permitted by law, our total liability for any claim arising out of the services is limited to the amount paid by you for the specific job giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, or for pre-existing conditions, latent defects, acts of nature, or damage caused by items not disclosed to us before work began. Nothing in these Terms limits liability that cannot be limited under Washington law.
SMS Terms

The types of messages we send include quote follow-ups, scheduling confirmations and reminders, crew arrival updates, and service completion notifications.
